Shop Act in Uttar Pradesh: An insight .

The Uttar Pradesh Shop License or Shop & Commercial Establishment Act,1962 was formed. The motive was to regulate the working conditions or specifying the services of employees who work in any kind of shop or commercial establishment. This Act is applicable for all the mercantile, business firm, or commercial holdings lying within the boundaries of the state Uttar Pradesh.

Exemptions under the Shop Act in Uttar Pradesh.

Under Section 3 of The Shop License Act or trade license act. There are several exemptions made by the government for some entities mentioned below-

  • Offices of Reserve Bank of India.
  • Workplace/Offices of Local Authorities or Government.
  • Employees whose work is sporadic or inherently intermittent/irregular.
  • Employees who hold the position such as managerial, supervisory, or confidential.
  • Treatment institutes or establishments for care of the sick, infirm, or mentally unfit and;
  • Family members of an employer.

The Registration Procedure and Its Requirements.

To get shop registration in up, one has to go through the following procedures to get firm registered 

Within 3 months of commencing a business, the owner is required to make an application in Form- to the Chief Inspector concerned for the registration of his/her shop or trade licence under labour act management system

The trade licence form filled in Form-should be accompanied by the following documents:

 

The Inspector after verifying and acknowledging the true and fair image of the details mentioned & documents attached with the application, shall register the shop or the commercial establishment and issue a registration certificate in Form

Note: After the certificate of registration is issued by e nagar sewa, the validity of the certificate is for 5-years.

Once online license up registration of an establishment is completed on uplabour.gov.in, the owner is provided with a specific Registration Number by e nagarsewa. After that, a trade licence certificate download will be available. The registration number should be displayed at a conspicuous place in a shop.

Requirements of the Act.

The employer should look after the working hours as determined under the Shop Act for a child, young or other employees which are 5,6 and 8 hours respectively. An adult should be deployed to work for more than 10 hours & overtime should also not exceed more than 50 hours in a quarter. Every commercial shop or establishment is required to give a 1-day mandatory leave in a week.

  • An employee shall be entitled to Earned Leave = 15-days, Sickness Leave = 15-days, Casual Leave = 10-days.
  • Maternity Leave: 6-weeks immediately preceding the day of delivery & 6-weeks following the day of delivery.

Timely wages to the employees must be provided, it may be monthly, daily, weekly, or fortnightly. On termination of employment full payment should be made to the worker.
